ONLINE BOOKING TERMS & CONDITIONS

DEFINITIONS In these Online Booking Terms & Conditions:

“Booking” means a booking for a Property.

“Booking Conditions” means the terms and conditions of these online booking terms & conditions.

“Booking Form” means the booking form supplied on the Website.

“Owner” means the owner of the Selected Property.

Property Agreement” means the contract between the You and the Owner.

“Property” means any of the properties advertised on the Website.

“Property Assistance” means the local property contact and property management.

“Rental Fee” means the total fee for the Selected Property as set out on the Website or as otherwise agreed in writing including rental, heating, electricity, use of bed linen and towels, if supplied (and VAT if applicable) but excluding any charges for additional services provided by Chalet Alp Lux.

“Rental Period” means the period of time for which You wish to rent the Selected Property as stated in the Booking Form or other written confirmation of the Booking from You.

“Chalet Alp Lux” means Chalet Alp Lux Ltd, a company registered in England and Wales with company number 10226840 whose registered office is at 24 Broad Street, Stamford. Lincolnshire, PE9 1PJ, UK.

“Selected Property” means the Property specified by You in a Booking.

“Website” means Chalet Alp Lux Website at www.chalet-alp-lux.com

“You” means the person who makes a Booking.

1.              AGENCY

1.1.          Chalet Alp Lux arranges short term holiday rentals of the Properties (including the marketing and booking services) as agent for the Owner of the relevant Property.

2.              CONTRACTS

2.1.          The separate Property Agreement for renting the Selected Property is between You and the Owner.

2.2.          These Booking Conditions are in relation to the booking service between You and Chalet Alp Lux.

2.3.          By making a Booking you are deemed to have made an offer to enter into two contracts for the letting of the Selected Property with: (i) the Owner in accordance with the Property Agreement; and (ii) with Chalet Alp Lux in accordance with these Booking Conditions.

2.4.          The Booking will be deemed accepted and the two contracts will come into existence when Chalet Alp Lux issues a booking confirmation form to you pursuant to clause 3.5.

2.5.          You agree to adhere to the provisions set out in these Booking Conditions and the Property Agreement.

3.              BOOKING AND PAYMENT

3.1.          You may make a Booking by either:

  • Contacting Chalet Alp Lux by telephone on +44 (0)1780 590 602
  • Sending an email giving details of your Booking requirements to stay@chalet-alp-lux.com
  • Booking online at www.chalet-alp-lux.com

3.2.          If, when making your Booking, the start date of your proposed Rental Period is more than 8 weeks away, You must pay a deposit to Chalet Alp Lux. This deposit is 25% of the Rental Fee. The balance of the Rental Fee is payable 8 weeks before the start of the Rental Period.

3.3.          The entire Rental Fee is payable at the same time as your Booking if the Booking is made 8 weeks or less before the start of the Rental Period.

3.4.          Chalet Alp Lux reserves the right to cancel your Booking at any time and retain the deposit if the balance is not received by the due date.

3.5.          Chalet Alp Lux will issue a Booking confirmation to you once you have either made a booking directly or you have successfully completed our online booking form and in all cases all money due at the time of Booking has been received in cleared funds. You should check the confirmation form carefully and notify Chalet Alp Lux immediately in case of any discrepancy or mistake.

3.6.          Chalet Alp Lux or the Owner may at any time before Chalet Alp Lux issues a confirmation form accept bookings from other customers for the Selected Property.

3.7.          If the Selected Property is unavailable for your selected Rental Period and Chalet Alp Lux is unable to accept the Booking for this or any other reason, Chalet Alp Lux will return all money received from you in full.

3.8.          Local Tourist Tax is applicable to all guests over a certain age, this can vary based upon location. Chalet Alp Lux is responsible for the payment of this Tax to the Local Tourist Office. This nominal charge will be added separately to Your online booking.

3.9.          The final house clean is mandatory and chargeable as part of your Booking. It is added separately to Your online booking.

4.              METHODS OF PAYMENT

4.1.          You may pay by cheque, credit card, debit card or BACS.

4.2.          For Bookings made less than 3 weeks before the start of the Rental Period, no cheques will be accepted and payment must be made in cleared funds, i.e. by credit card, debit card or BACS.

4.3.          All cheque payments shall be made to Chalet Alp Lux at the address stated in these Booking Conditions and made payable to ‘Chalet Alp Lux Limited’.

5.              CANCELLATION 

5.1.          If you cancel or amend the accepted/ confirmed Booking for any reason, you must notify Chalet Alp Lux as soon as possible in writing at the address or email stated in these Booking Conditions. If you cancel your booking within 7 days of receiving the booking confirmation Chalet Alp Lux will refund the balance of any money you have paid to Chalet Alp Lux.

5.2.          A cancellation charge is payable depending on the time before the Rental Period start date that the notice of cancellation is received by Chalet Alp Lux. The amount payable is set out below, where the number of weeks refers to the time from cancellation to Rental Period start date and the cost refers to the percentage of the rental cost of the Selected Property:

5.2.1.               More than 8 weeks prior to the Rental Period arrival, Chalet Alp Lux reserve the right to retain the deposit (25% of the Rental Fee) and refund any balance held.

5.2.2.               Less than 8 weeks prior to the Rental Period arrival, Chalet Alp Lux reserve the right to charge 100% of the rental value.

5.3.          Please note, in the instance of clause 5.2.2 Chalet Alp Lux will make every effort to re-let the property and in that event will refund your payment to us less the deposit paid. However Chalet Alp Lux strongly recommends that you take out HOLIDAY CANCELLATION INSURANCE with your insurance broker.

5.4.          Chalet Alp Lux cannot be responsible for an ‘Act of God’ and we remind guests that we cannot be held responsible for natural disasters and other events out of our control. Guests should take out adequate travel insurance to cover them in the event of such circumstances.

5.5.          If you decide to switch your booking to an alternative Property, you will be sent a confirmation form setting out details of the new Property, Rental Fee and Rental Period and you will be deemed to have entered into a new contract with the Owner of the new Property (deemed to be the Selected Property), such contract to have incorporated these Booking Conditions and you shall be liable to make payments in accordance with these Booking Conditions.

6.              RENTAL PERIOD

6.1.          The Rental Period commences, unless otherwise notified, at 4.00 pm on the day of arrival and terminates at 10.00 am on the day of departure.

6.2.          There is a Property minimum stay applicable. This is either 3 of 7 nights at certain times of the year. Late departures and early arrival may be available at Chalet Alp Lux’s discretion.

6.3.          Chalet Alp Lux will notify you, once you have paid the Rental Fee in full, if the extended stay is available.

6.4.          If your stay extends beyond the period of hire in clause 6.1, or such other period as expressly agreed in condition 6.2, you will be subject to a charge for the additional time based on the applicable daily rate for the Selected Property.

7.              CHANGES OF RENTAL PERIOD

Chalet Alp Lux will endeavour, but is under no obligation, to consider a request from you to change the Rental Period after it has been confirmed and accepted. Such a request will only be accepted if the Selected Property is available for the new period requested.

8.               CARE OF SELECTED PROPERTY

8.1.          You agree to keep the Selected Property and its contents in the same condition and repair as found on your arrival at the Selected Property and shall procure that your guests shall also take such care of the Selected Property and its contents.

8.2.          Included within the price of Your Booking for every Selected Property is a Damage Waiver deposit collected on behalf of the Owner, which covers the costs of making good any loss or damage to the Selected Property and/or its contents caused through act or omission of You or any of your guests up to a predetermined amount depending on the size of the Selected Property. This amount will be specified in the booking confirmation. Where any such damage so caused exceeds this amount, You agree to pay to Chalet Alp Lux, acting on behalf of the Owner, upon written demand, any reasonable costs incurred in making good any such loss or damage above the predetermined amount.

8.3.          You shall abide by all instructions with regard to the use of the Selected Property and its fixtures and fittings as notified to You by Chalet Alp Lux or the Property Assistance from time to time.

8.4.          You must ensure that the Selected Property is left in a clean and tidy condition on your departure at the end of the Rental Period. Chalet Alp Lux may charge you for the reasonable costs of any additional cleaning if this is reasonably considered necessary.

9.               RIGHT OF ENTRY

Chalet Alp Lux, the Property Assistance and the Owner shall have the right of entry to the Selected Property at all reasonable times, except in an emergency where immediate access may be required, for the purposes of inspection or to carry out any necessary repairs or maintenance.

10.           RIGHT TO REFUSE BOOKINGS AND TO TERMINATE CONTRACT

10.1.       Chalet Alp Lux and the Owner reserve the right to refuse Bookings from: a) groups of people under the age of 21; and/or b) hen or stag parties.

10.2.       You must inform Chalet Alp Lux at the time of Booking if your party falls in condition 12.1 and/or 12.2.

10.3.       Chalet Alp Lux and the Owner reserve the right to terminate these Booking Conditions or the Property Agreement without prejudice to any rights and remedies accrued by Chalet Alp Lux or the Owner or You which shall remain following termination and ask You and your guests to leave the Selected Property immediately if it is deemed necessary by Chalet Alp Lux or the Owner as a result of your behaviour or that of any of your guests and/or any other material breach of these Booking Conditions and/or the Property Agreement.

10.4.       In the event that these Booking Conditions and/or the Property Agreement is terminated in accordance with condition 12.3, the Owner reserves the right not to refund to you any part of the Rental Fees in respect of the shortened Rental Period.

11.            COMPLAINTS

11.1.       Should there be any cause for complaint during your stay in the Selected Property,
you should notify Chalet Alp Lux promptly and describe the nature of the complaint. Chalet Alp Lux will use its reasonable endeavours to resolve any complaints on behalf of the Owner but, in accordance with condition 13.2, accepts no liability for its actions all of which are performed on behalf of the Owner who shall be solely liable.

11.2.       You will be provided with the telephone number of the Property Assistance who you can contact in the event that you have a problem in relation to the Property. Chalet Alp Lux will use their reasonable endeavours to resolve any issues.

11.3.       If the Property Assistance is unavailable, please contact the Chalet Alp Lux on +44 (0)1780 590 602.

11.4.       If you wish to make a complaint after your Rental Period has ended please do so to Chalet Alp Lux in writing within a reasonable period but note that compensation cannot be offered where a complaint has not been raised during your stay.

12.           LIABILITY

12.1.       Chalet Alp Lux acts as agent on behalf of the Owner and is not liable to You or any of your party under or in connection with the Property Agreement  or for any acts or omissions of the Owner or its other agents or representatives.

12.2.       Nothing in these Booking Conditions shall limit or exclude the liability of the Owner or Chalet Alp Lux for death or personal injury resulting from its negligence or for fraudulent misrepresentation or for any liability which cannot be excluded by law.

12.3.       Subject to condition 12.2 Chalet Alp Lux shall not be liable for any actual or alleged indirect or consequential loss howsoever arising suffered by You, or for any loss (either direct or indirect) of profits, anticipated profits, savings, business or opportunity or loss of publicity or loss of reputation or opportunity to enhance reputation.

12.4.       Subject as stated in condition 12.2, the aggregate liability of Chalet Alp Lux to You for breach of contract, misrepresentation, in tort or otherwise arising under or in connection with these Booking Conditions shall be limited to damages not exceeding three times the total amount of the Rental Fee received from You.

13.           FORCE MAJEURE

Neither Chalet Alp Lux nor the Owner shall be liable for any delay or non-performance of their obligations under the Contract to the extent that the performance is interrupted or prevented by any act or omission beyond its reasonable control. Chalet Alp Lux or the Owner shall as soon as reasonably practicable upon it becoming aware of the same notify You.

14.           DATA PROTECTION

14.1.       We will only use your personal information as set out in our Privacy Policy, which is available on our website, or on request by contracting us.

15.           MISCELLANEOUS

15.1.       If any provision of the Contract (or part of any provision) is found by any court or other authority of competent jurisdiction to be invalid, illegal or unenforceable, that provision or part-provision shall, to the extent required, be deemed not to form part of the Contract, and the validity and enforceability of the other provisions of the Contract shall not be affected.

15.2.       You shall not, without the prior written consent of Chalet Alp Lux acting as agent for the Owner, assign or transfer, or deal in any other manner with all or any of your rights or obligations under this Contract.

15.3.       A person (other than Chalet Alp Lux) who is not a party to this Contract shall not have any rights under or in connection with it.

15.4.       The Contract shall be governed by and construed in accordance with English law and shall be subject to the exclusive jurisdiction of the English Courts.

15.5.       Neither the Owner nor Chalet Alp Lux can be held responsible for any buildings or road workings which may be carried out close to your Selected Property. Where we are aware of any anticipated works, we will endeavour to advise You in advance.

15.6.       We reserve the right to alter or withdraw amenities or facilities or any activities without prior notice where reasonably necessary due to repairs, maintenance, weather conditions and circumstances beyond our control.

15.7.       Chalet Alp Lux reserve the right to update Booking Conditions from time to time.

PROPERTY AGREEMENT

This Agreement is between You and the Owner of the Property. By making a Booking, you agree to adhere to the terms set out below.

Chalet Alp Lux and the Owner of the Property aim to ensure that the particulars of the Property as they appear on the Website are accurate. Nevertheless, on occasions there may have been a change of circumstances and the Website cannot always be up to date. Please ensure that you check all of the details on your Selected Property (including price) with Chalet Alp Lux at the time of Booking. Chalet Alp Lux will endeavour to notify you of any changes or inaccuracies in any information on the Website, or otherwise provided to you, as soon as reasonably practical after we become aware of any such change. Chalet Alp Lux reserve the right to amend the prices shown on behalf of the Owner. If the correct price is higher than the price illustrated on the website, Chalet Alp Lux will contact you to ask if you wish to proceed with your booking.

LIABILITY

Nothing in this Property Agreement shall limit or exclude the liability of the Owner for death or personal injury resulting from its negligence or for fraudulent misrepresentation or for any liability which cannot be excluded by law.

The Owner shall not be liable for any actual or alleged indirect or consequential loss howsoever arising suffered by You, or for any loss (either direct or indirect) of profits, anticipated profits, savings, business or opportunity or loss of publicity or loss of reputation or opportunity to enhance reputation.

The aggregate liability of the Owner to You for breach of contract, misrepresentation, in tort or otherwise arising under or in connection with the Property Agreement shall be limited to damages not exceeding three times the total amount of the Rental Fee.

This Property Agreement shall be governed by and construed in accordance with English law and shall be subject to the exclusive jurisdiction of the English Courts.

 GUEST SAFETY

The Owner and Chalet Alp Lux take the safety of guests very seriously. We ask that guests who stay in the Property take a few moments to think about their safety at the Property. In particular You should:

1)  Check the layout of the Property, so that in an emergency You and your party can get out quickly and easily.

2)  Read and take note of any specific safety information provided in the Property Arrival Information document.

If you have any concerns about the safety of the Property, whether it be the garden, equipment or facilities, You should contact the Property Assistance or Chalet Alp Lux immediately.

TRADITIONAL PROPERTIES

As being traditional chalets, please bear in mind if your party includes an elderly or disabled person or young children that some of the chalet features (such as steep stairs, low beams, restricted head height, uneven floors) may mean that the Property is not suitable. Please consider this when selecting a Property before making any Booking; please note that such features are illustrated on the Chalet Alp Lux Website.

LOCATION

Properties are situated in Alpine locations can include steep non-surfaced roads/tracks. Please be aware that it is a legal requirement in Austria to carry snow chains in Your vehicle. At all property locations wintery snowy conditions can be challenging, it may be necessary to use chains to safely arrive or depart the property.  Please note it is usually best to reverse under these conditions.

USE OF SELECTED PROPERTY

  1. You agree that the Property will not be sub-let.
  2. You agree that the number of people staying in the Property will not exceed the maximum number stipulated within the booking.
  3. You agree that the Property will be used for personal and domestic purposes only.
  4. You agree that the Property will not be used for any commercial purposes.
  5. You agree that the Property will not be used for any activity or in such a way as to cause a nuisance or annoyance to neighbours of the Property.
  6. You and your guests will comply with any reasonable regulations relating to the Property or the site within which the Property is situated, which will be communicated to you upon/prior to your arrival at the Property.

PETS

Pets are not permitted in the Property.

Chalet Alp Lux and the Owner reserve the right to terminate  the Booking Conditions and/or Property Agreement without prejudice to any rights and remedies accrued by Chalet Alp Lux or the Owner or You which shall remain following termination and ask You and your guests to leave the Property immediately if it is deemed necessary by Chalet Alp Lux or the Owner as a result of you or your guests bringing a pet into the Property.

ARRIVAL AND DEPARTURE

Arrival is from 4.00 pm on the first day of your Rental Period. Your Property Assistance will arrange to meet with you at Your Selected Property to show you around and explain some of the features of the property. Please telephone your Property Assistance 30 mins prior to your arrival or to inform them if you are running significantly late.  Contact details of your Property Assistance will be included in the Property Arrival Information document. Departure is by latest 10.00 am on the last day of your Rental Period.  The property must be left in an orderly state, dishes washed, fridge emptied and rubbish separated and disposed of.

KEY COLLECTION/RETURN

Key collection is by self check-in with a lock box location at the Selected Property.  Keys are to be returned to the lock box on departure.

LOST PROPERTY

Any lost property found in the Property after your departure will be returned to you, on your request, and at your cost. Any such cost may be deducted from your deposit. Please note that all lost property that has not been claimed and returned to you shall be disposed of after four weeks from the date of your departure.

COMPLAINTS

Property Owners and Assistance aim to ensure you have an enjoyable and comfortable stay at their property. Unfortunately, things sometimes can go wrong while on holiday but these situations are always best resolved at the time. Your contract is between You and the Owner. However, in the event of a problem you should contact the Property Assistance (if unavailable, Chalet Alp Lux at Lucy@chalet-alp-lux.com or by telephoning +44 (0) 1780 590602) immediately to allow remedial action to be taken. In the case of an emergency, it is imperative that we see the reason for the complaint before any remedial action is taken.  We regret that we cannot consider any complaints where we have not been given the opportunity to investigate the complaint and endeavored to put matters right during the Rental Period.

Please note any complaints raised on or after your departure will not result in any form of compensation. The property you have booked is a domestic home and the Owner does not always have access to 24 hour a day maintenance services.

GUEST DAMAGE

You should report accidental damage or breakage as and when it happens so that we can fix it for You or in advance of the arrival of the next guests. Chalet Alp Lux reserve the right to charge You the reasonable costs incurred by Chalet Alp Lux, the Property Assistance or the Owner to repair or replace any broken or damaged items.

DAMAGE DEPOSIT

This applies to all Selected Properties. You will be advised of the amount at the time of Booking. The damage deposit will be refunded at the end of your holiday rental (less any costs for breakages, damage etc. if applicable).

NON-SMOKING

There is strictly no smoking permitted inside any of the Selected Properties (including e-cigarettes).  If you wish to smoke please enjoy your cigarette outside making sure that all cigarette ends are extinguished properly and disposed of along with the ashes.

WI-FI AND INTERNET

We provide free Wi-Fi internet connections for our guests, but this is subject to local signal strength and atmospheric conditions which can adversely affect connection and are outside our control. We shall not be liable for any failure or unavailability of the Wi-Fi internet signal or connection. 
If guests use our free Wi-Fi internet connection, they are solely responsible for complying with all relevant laws and ensuring that no computer or software virus, inappropriate or illegal material, is accessed or downloaded, and we shall be fully indemnified by any guest using our Wi-Fi internet service against any computer or software virus which is downloaded and damages our software, systems or hardware, and against any other consequences of the accessing or downloading of inappropriate or illegal material.
It is the sole responsibility of each guest to ensure that any parental locks or other restrictions are in place, and we cannot accept any responsibility for any inappropriate access or use of the internet by children or others.

PARKING

Property parking is limited to the number Illustrated on the website. Vehicles are to be parked in designated parking areas only. Parking on the road or adjacent grassy verges is not permitted. Any illegally parked cars are subject to towing; applicable fines/towing fees are the sole responsibility of the vehicle owner.

SKIS, BICYCLES AND GOLF CLUBS

Guests bringing their own or rental ski equipment, bicycles or Golf Clubs to a Property must ensure that they are locked away. Please supply your own locks for bicycles and golf clubs and ensure that ski equipment is stored in the lockable ski store provided. Neither Chalet Alp Lux nor the Owner will not be held responsible for the damage or theft to Ski equipment golf clubs or bicycles left on the property.  Skis Bicycles and golf clubs are not permitted inside the property.

SKI BOOTS

All Properties have heated storage for Ski boots, helmets can also be stored here.  Please note that ski boots are not to be worn in the property.

TOBOGGANS

All properties have toboggans for your use. Please enjoy them and report any damages to Chalet Alp Lux or the Property Assistance.

WOOD BURNING STOVES

Selected properties have wood burning stoves. Please only use the wood supplied and never put anything on top of the stove! It gets very hot.

BBQ’S and FIRE PIT

All properties have a BBQ and or a fire pit.  Please feel free to use, making sure that it is never left unattended.

FIRE EXTINGUISHER

There is a fire extinguisher in the property, if for any reason you cannot locate this upon arrival, please contact either Chalet Alp Lux or the Property Assistance.

DEBRIS/RUBBISH

It is important to recycle at your property.  There are clear instructions on the bins located at each of the properties.  Please adhere to the rules on waste disposal, it causes an enormous amount of hassle for the Property Housekeeping, any additional time taken will be deducted from the damage deposit.

CLEANING

Dirty dishes are to be packed into the dishwasher and switched on prior to departure.  Pots and pans are to be washed.  The final clean cost has been built into your booking and covers the dusting, linen, windows, kitchen, bathrooms and cleaning of all the floors.

HOT TUBS AND SAUNAS

Some of the properties have a hot tub, sauna or both, information regarding these is illustrated on the Chalet Alp Lux website. Misuse and subsequent damage to a hot tub or a sauna can be expensive to repair. Chalet Alp Lux and the Owner ask that guests take note to the instructions listed in the Property Arrival document. The property Assistance will also take you through the do’s and dont’s. Please report any issues or damages as soon as they are noticed so that they can be attended to immediately. Neglecting to follow instructions given can result in damage and the cost will be deducted from your damage deposit.
