BOOKING
TERMS & CONDITIONS

Please read the booking documents (Booking Statement, Terms and Conditions and Property Agreement) carefully as they are legally binding and constitute the terms and conditions with Heslop GmbH.

DEFINITIONS In these Booking Terms & Conditions:
“Booking” means a booking for a Property.
“Booking Conditions” means the terms and conditions of these online booking terms & conditions.
“Booking Statement” means the booking form supplied on the Website.
“Owner” means the owner of the Selected Property.
“Property Agreement” means the contract between the You and the Owner.
“Property” means any of the properties advertised on the Website.
“Property Host” means the local property contact and property management.
“Rental Fee” means the total fee for the Selected Property as set out on the Website or as otherwise agreed in writing including rental, heating and electricity, but excluding any charges for MwSt and Tourist Tax and additional services (such as linen and cleaning) provided by Chalet Alp Lux.
“Rental Period” means the period of time for which You wish to rent the Selected Property as stated in the Booking Statement or other written confirmation of the Booking from You.
“Chalet Alp Lux” means Heslop GmbH trading as Chalet Alp Lux

“Heslop GmbH” means the Owner of the Property and company
“Selected Property” means the Property specified by You in a Booking.
“Website” means Chalet Alp Lux Website at www.chalet-alp-lux.com
“You” means you the person, group leader who makes the booking.

1.

THE BOOKING

1.1.

For marketing, advertising and booking, Heslop GmbH is trading as Chalet Alp Lux.

1.2.

These Terms and Conditions, together with the Booking Form and Property Agreement contain all the provisions of your booking with Heslop GmbH.
These apply equally to you, the group leader and all guests staying in the Property and visitors you invite to the Property, including staff, friends and service providers.

2.

CONTRACTS

2.1.

The separate Property Agreement for renting the Selected Property is between You and Heslop GmbH.

2.2.

These Booking Conditions are in relation to the booking service between You and Heslop GmbH.

2.3.

By making a Booking you are deemed to have made an offer to enter into two contracts for the letting of the Selected Property (i) with Heslop GmbH in accordance with the Property Agreement; and (ii) with Heslop GmbH in accordance with these Booking Conditions.

2.4.

The Booking will be deemed accepted and the two contracts will come into existence when Heslop GmbH issues a booking confirmation form to you pursuant to clause 3.5.

2.5.

You agree to adhere to the provisions set out in these Booking Conditions and the Property Agreement.

3.

BOOKING AND PAYMENT

3.1.

You may make a Booking by either:

  • Contacting Chalet Alp Lux by telephone on +43 664 548 6062
  •  Sending an email giving details of your Booking requirements to stay@chalet-alp-lux.com
  • Booking directly online at www.chalet-alp-lux.com

3.2.

If, when making your Booking, the start date of your proposed Rental Period is more than 4 weeks, You must pay a deposit to Heslop GmbH. This deposit is 25% of the Rental Fee. The balance of the Rental Fee is payable either before or up to 4 weeks before the start of the Rental Period.

3.3.

The entire Rental Fee is payable at the same time as your Booking if the Booking is made 4 weeks or less before the start of the Rental Period. The entire Rental Fee is payable at the time for your booking if the booking is made 4 weeks or less before the start of the Rental Period.

3.4.

Heslop GmbH reserves the right to cancel your Booking at any time and retain the deposit if the balance is not received by the due date.

3.5.

Heslop GmbH will issue a Booking Confirmation and Booking Statement to you once you have either made a booking directly or you have successfully completed our booking form and in all cases all money due at the time of Booking has been received in cleared funds. You should check the confirmation and Statement carefully and notify Heslop GmbH immediately in case of any discrepancy or mistake.

3.6.

Heslop GmbH may at any time before Chalet Alp Lux issues a Booking Confirmation accept bookings from other customers for the Selected Property.

3.7.

If the Selected Property is unavailable for your selected Rental Period and Heslop GmbH is unable to accept the Booking for this or any other reason, Heslop GmbH will return all money received from you in full.

3.8.

Local Tourist Tax is applicable to all guests over 15 years of age, this can vary based upon location. Heslop GmbH is responsible for the payment of this Tax to the municipality. This nominal charge will be added separately to Your booking and charged upon arrival.

3.9.

The Guest Service Pack which includes the final house clean is mandatory and chargeable as part of your Booking. It is added separately to Your Booking.

3.10.

The rental fee will be subject to Austrian VAT known as UST MwSt at 10%, this will be added separately to Your booking.

4.

METHODS OF PAYMENT

4.1.

You may pay by cheque, credit card, debit card or bank transfer.

4.2.

For Bookings made less than 3 weeks before the start of the Rental Period, no cheques will be accepted and payment must be made in cleared funds, i.e. by credit card, debit card or bank transfer.

4.3.

All cheque payments shall be made to Heslop GmbH at the address stated in these Booking Conditions and made payable to ‘Heslop GmbH’.

5.

CANCELLATION

5.1.

If you cancel or amend the accepted/ confirmed Booking for any reason, you must notify Heslop GmbH as soon as possible in writing at the address or email stated in these Booking Conditions. If you cancel your booking within 7 days of receiving the booking confirmation Heslop GmbH will refund the balance of any money you have paid.

5.2.

A cancellation charge is payable depending on the time before the Rental Period start date that the notice of cancellation is received by Chalet Alp Lux. The amount payable is set out below, where the number of weeks refers to the time from cancellation to Rental Period start date and the cost refers to the percentage of the rental cost of the Selected Property:
  • Within 7 days of Booking Confirmation, cancel or amend free of charge
  • Up to 4 weeks before arrival 25% cancellation fee will be charged
  • Within 4 weeks before arrival 100% cancellation fee

5.3.

Please note, in the instance of a 100% cancellation fee Heslop GmbH will make every effort to re-let the property and in that event will refund your payment to us less the deposit paid. However Heslop GmbH strongly recommends that you take out HOLIDAY CANCELLATION INSURANCE with your insurance broker.

5.4.

Heslop GmbH cannot be responsible for an ‘Act of God’ and we remind guests that we cannot be held responsible for natural disasters and other events out of our control. Guests should take out adequate travel insurance to cover them in the event of such circumstances.

5.5.

If you decide to switch your booking to an alternative Property, you will be sent a confirmation form setting out details of the new Property, Rental Fee and Rental Period and you will be deemed to have entered into a new contract with the Owner of the new Property (deemed to be the Selected Property), such contract to have incorporated these Booking Conditions and you shall be liable to make payments in accordance with these Booking Conditions.

5.6.

For 2021 – Covid–19 Situation. Cancellation of Your Booking free of charge up to 24 hours prior to Your Rental Period start date should one of these reasons exist.

5.6.1. Travel warning for the state of Salzburg
5.6.2. State quarantine orders
5.6.3. Personal illness, positive Covid-19 test result
5.6.4. Red Corona traffic light status for the region of Zell am See
5.6.5. Discontinuation of skiing operations within the Zell am See region due to Covid -19

6.

RENTAL PERIOD

6.1.

The Rental Period commences, unless otherwise notified or directly agreed, at 16.00 on the day of arrival and terminates at 10.00 on the day of departure. Late departures and early arrival may be available at Heslop GmbH discretion.

6.2.

There is a Property minimum stay applicable. This is either 3 nights during the summer/low season or 7 nights during the winter/high season across the operational year. Changes to duration of stay may be available at Heslop GmbH discretion.

6.3.

Heslop GmbH will notify you, once you have paid the Rental Fee in full and if the extended stay is available.

6.4.

If your stay extends beyond the period of hire in clause 6.1, or such other period as expressly agreed in condition 6.2, you will be subject to a charge for the additional time based on the applicable daily rate for the Selected Property.

7.

CHANGES OF RENTAL PERIOD

Heslop GmbH will endeavour, but is under no obligation, to consider a request from you to change the Rental Period after it has been confirmed and accepted. Such a request will only be accepted if the Selected Property is available for the new period requested.

8.

CARE OF SELECTED PROPERTY

8.1.

You agree to keep the Selected Property and its contents in the same condition and repair as found on your arrival at the Selected Property and shall procure that your guests shall also take such care of the Selected Property and its contents.

8.2.

Included within the price of Your Booking for every Selected Property is a Security Deposit collected on behalf of the Owner, this payment covers the costs of making good any loss or damage to the Selected Property and/or its contents caused through act or omission of You or any of your guests up to a predetermined amount depending on the size of the Selected Property. This amount will be specified in the Booking confirmation. Where any such damage so caused exceeds this amount, You agree to pay to Heslop GmbH as the Owner, upon written demand, any reasonable costs incurred in making good any such loss or damage above the predetermined amount.

8.3.

You shall abide by all instructions with regard to the use of the Selected Property and its fixtures and fittings as notified to You by Heslop GmbH or the Property Host from time to time.

8.4.

You must ensure that the Selected Property is left in a clean and tidy condition on your departure at the end of the Rental Period. Heslop GmbH may charge you for the reasonable costs of any additional cleaning if this is reasonably considered necessary.

9.

RIGHT OF ENTRY

Heslop GmbH, as both the Agent and Owner and the Property Host shall have the right of entry to the Selected Property at all reasonable times, except in an emergency where immediate access may be required, for the purposes of inspection or to carry out any necessary repairs or maintenance.

10.

RIGHT TO REFUSE BOOKINGS AND TO TERMINATE CONTRACT

10.1.

Heslop GmbH and the Owner reserve the right to refuse Bookings from: a) groups of people under the age of 21; and/or b) hen or stag parties.

10.2.

You must inform Heslop GmbH at the time of Booking if your party falls in condition 10.1 a) or b)

10.3.

Heslop GmbH and the Owner reserve the right to terminate these Booking Conditions or the Property Agreement without prejudice to any rights and remedies accrued by Heslop GmbH or the Owner or You which shall remain following termination and ask You and your guests to leave the Selected Property immediately if it is deemed necessary by Heslop GmbH or the Owner as a result of your behaviour or that of any of your guests and/or any other material breach of these Booking Conditions and/or the Property Agreement.

10.4.

In the event that these Booking Conditions and/or the Property Agreement is terminated in accordance with condition 12.3, the Owner reserves the right not to refund to you any part of the Rental Fees in respect of the shortened Rental Period.

11.

COMPLAINTS

11.1.

Should there be any cause for complaint during your stay in the Selected Property,
you should notify Heslop GmbH promptly and describe the nature of the complaint. Heslop GmbH will use its reasonable endeavours to resolve any complaints on behalf of the Owner but, in accordance with condition 14.1, accepts no liability for its actions all of which are performed on behalf of the Owner who shall be solely liable.

11.2.

You will be provided with the telephone number of the Property Host who you can contact in the event that you have a problem in relation to the Property. Heslop GmbH will use their reasonable endeavours to resolve any issues.

11.3.

If the Property Host is unavailable, please contact the Chalet Alp Lux on +43 664 5486062.

11.4.

If you wish to make a complaint after your Rental Period has ended please do so to Heslop GmbH in writing within a reasonable period but note that compensation cannot be offered where a complaint has not been raised during your stay.

12.

LIABILITY

12.1.

Chalet Alp Lux acts as the agent on behalf of the Owner, Heslop GmbH and is not liable to You or any of your party under or in connection with the Property Agreement or for any acts or omissions of the Owner or its other agents or representatives.

12.2.

Nothing in these Booking Conditions shall limit or exclude the liability of the Heslop GmbH for death or personal injury resulting from its negligence or for fraudulent misrepresentation or for any liability which cannot be excluded by law.

12.3.

Subject to condition 12.2 Heslop GmbH shall not be liable for any actual or alleged indirect or consequential loss howsoever arising suffered by You, or for any loss (either direct or indirect) of profits, anticipated profits, savings, business or opportunity or loss of publicity or loss of reputation or opportunity to enhance reputation.

12.4.

Subject as stated in condition 12.2, the aggregate liability of Heslop GmbH to You for breach of contract, misrepresentation, in tort or otherwise arising under or in connection with these Booking Conditions shall be limited to damages not exceeding three times the total amount of the Rental Fee received from You.

13.

FORCE MAJEURE

Heslop GmbH shall not be liable for any delay or non-performance of their obligations under the Contract to the extent that the performance is interrupted or prevented by any act or omission beyond its reasonable control. Heslop GmbH shall as soon as reasonably practicable upon it becoming aware of the same notify You.

14.

DATA PROTECTION AND PRIVACY

14.1.

Heslop GmbH will only use your personal information as set out in our Privacy Policy, which is available on our website, or by request by contacting us.

15.

MISCELLANEOUS

15.1.

If any provision of the Contract (or part of any provision) is found by any court or other authority of competent jurisdiction to be invalid, illegal or unenforceable, that provision or part-provision shall, to the extent required, be deemed not to form part of the Contract, and the validity and enforceability of the other provisions of the Contract shall not be affected.

15.2.

You shall not, without the prior written consent of Heslop GmbH, assign or transfer, or deal in any other manner with all or any of your rights or obligations under this Contract.

15.3.

A person (other than Heslop GmbH) who is not a party to this Contract shall not have any rights under or in connection with it.

15.4.

Heslop GmbH will not be held responsible for any buildings or road workings which may be carried out close to your Selected Property. Where we are aware of any anticipated works, we will endeavour to advise You in advance.

15.5.

We reserve the right to alter or withdraw amenities or facilities or any activities without prior notice where reasonably necessary due to repairs, maintenance, weather conditions and circumstances beyond our control.

15.6.

Heslop GmbH trading as Chalet Alp Lux reserve the right to update Booking Conditions from time to time. Any updates to the terms printed here will be reflected on our Website, and included in the contract that You receive.
