PROPERTY
AGREEMENT

This Agreement is between You and Heslop GmbH. By making a Booking, you agree to adhere to the terms set out below.

 

Heslop GmbH trading as Chalet Alp Lux aim to ensure that the particulars of the Property as they appear on the Website are accurate. Nevertheless, on occasions there may have been a change of circumstances and the Website cannot always be up to date. Please ensure that you check all of the details on your Selected Property (including price) with Chalet Alp Lux at the time of Booking. Chalet Alp Lux will endeavour to notify you of any changes or inaccuracies in any information on the Website, or otherwise provided to you, as soon as reasonably practical after we become aware of any such change. Chalet Alp Lux reserve the right to amend the prices shown on behalf of the Owner. If the correct price is higher than the price illustrated on the website, Chalet Alp Lux will contact you to ask if you wish to proceed with your booking.

LIABILITY

Nothing in this Property Agreement shall limit or exclude the liability of the Owner for death or personal injury resulting from its negligence or for fraudulent misrepresentation or for any liability which cannot be excluded by law. Heslop GmbH shall not be liable for any actual or alleged indirect or consequential loss howsoever arising suffered by You, or for any loss (either direct or indirect) of profits, anticipated profits, savings, business or opportunity or loss of publicity or loss of reputation or opportunity to enhance reputation. The aggregate liability of the Owner to You for breach of contract, misrepresentation, in tort or otherwise arising under or in connection with the Property Agreement shall be limited to damages not exceeding three times the total amount of the Rental Fee.

GUEST SAFETY

Heslop GmbH trading as Chalet Alp Lux take the safety of guests very seriously. We ask that guests who stay in the Property take a few moments to think about their safety at the Property. In particular You should:

1)  Check the layout of the Property, so that in an emergency You and your party can get out quickly and easily.

2)  Read and take note of any specific safety information provided in the Property Arrival Information document.

If you have any concerns about the safety of the Property, whether it be the garden, equipment or facilities, You should contact the Property Host or Chalet Alp Lux immediately.

TRADITIONAL PROPERTIES

As being traditional chalets, please bear in mind if your party includes an elderly or disabled person or young children that some of the chalet features (such as steep stairs, low beams, restricted head height, uneven floors) may mean that the Property is not suitable. Please consider this when selecting a Property before making any Booking; please note that such features are illustrated on the Chalet Alp Lux Website.

LOCATION

Properties are situated in Alpine locations can include steep non-surfaced roads/tracks. Please be aware that it is a legal requirement in Austria to carry snow chains in Your vehicle. At all property locations wintery snowy conditions can be challenging, it may be necessary to use chains to safely arrive or depart the property.  Please note it is usually best to reverse under these conditions.

USE OF SELECTED PROPERTY

  1. You agree that the Property will not be sub-let.
  2. You agree that the number of people staying in the Property will not exceed the maximum number stipulated within the booking.
  3. You agree that the Property will be used for personal and domestic purposes only.
  4. You agree that the Property will not be used for any commercial purposes.
  5. You agree that the Property will not be used for any activity or in such a way as to cause a nuisance or annoyance to any neighbours of the Property.
  6. You and your guests will comply with any reasonable regulations relating to the Property or the site within which the Property is situated, which will be communicated to you upon/prior to your arrival at the Property.

PETS  –  are NOT permitted in the Property.

Heslop GmbH trading as Chalet Alp Lux reserve the right to terminate  the Booking Conditions and/or Property Agreement without prejudice to any rights and remedies accrued by Heslop GmbH trading as Chalet Alp Lux or You which shall remain following termination and ask You and your guests to leave the Property immediately if it is deemed necessary by Heslop GmbH trading as Chalet Alp Lux as a result of you or your guests bringing a pet into the Property.

ARRIVAL AND DEPARTURE

Arrival is from 16.00 on the first day of your Rental Period. Your Property Host will arrange to meet with you at Your Selected Property to show you around and explain some of the features of the property. Please telephone your Property Host 1 hour prior to your arrival or to inform them if you are running significantly late.  Contact details of your Property Assistance will be included in the Property Arrival Information document. Departure is by latest 10.00 on the last day of your Rental Period.  The property must be left in an orderly state, dishes washed, fridge emptied and rubbish separated and disposed of.

KEY COLLECTION/RETURN

Key collection is either directly via your Property Host or by self check-in with a lock box location at the Selected Property.  Keys are to be returned to the lock box or left within the Property on departure.

LOST PROPERTY

Any lost property found in the Property after your departure will be returned to you, on your request, and at your cost. Any such cost may be deducted from your deposit. Please note that all lost property that has not been claimed and returned to you shall be disposed of after four weeks from the date of your departure.

COMPLAINTS

Property Owners and the Host aim to ensure you have an enjoyable and comfortable stay at their property. Unfortunately, things sometimes can go wrong while on holiday but these situations are always best resolved at the time. Your contract is between You and the Owner. However, in the event of a problem you should contact the Property Host (if unavailable, Chalet Alp Lux at Stay@chalet-alp-lux.com or by telephoning +43 664 548 6062) immediately to allow remedial action to be taken.

In the case of an emergency, it is imperative that we see the reason for the complaint before any remedial action is taken.  We regret that we cannot consider any complaints where we have not been given the opportunity to investigate the complaint and endeavored to put matters right during the Rental Period.

Please note any complaints raised on or after your departure will not result in any form of compensation. The property you have booked is a domestic home and Heslop GmbH does not always have access to 24 hour a day maintenance services.

GUEST DAMAGE

You should report accidental damage or breakage as and when it happens so that we can fix it for You or in advance of the arrival of the next guests. Chalet Alp Lux reserve the right to charge You the reasonable costs incurred by Chalet Alp Lux, the Property Host or the Owner to repair or replace any broken or damaged items.

SECURITY DEPOSIT

This applies to all Selected Properties. You will be advised of the amount at the time of Booking. The damage deposit will be refunded within 7 days at the end of your holiday rental (less any costs for breakages, damage etc. if applicable).

NON-SMOKING

There is strictly no smoking permitted inside any of the Selected Properties (including e-cigarettes).  If you wish to smoke please enjoy your cigarette outside making sure that all cigarette ends are extinguished properly and disposed of along with the ashes.

WI-FI AND INTERNET

We provide free Wi-Fi internet connections for our guests, but this is subject to local signal strength and atmospheric conditions which can adversely affect connection and are outside our control. We shall not be liable for any failure or unavailability of the Wi-Fi internet signal or connection. 
If guests use our free Wi-Fi internet connection, they are solely responsible for complying with all relevant laws and ensuring that no computer or software virus, inappropriate or illegal material, is accessed or downloaded, and we shall be fully indemnified by any guest using our Wi-Fi internet service against any computer or software virus which is downloaded and damages our software, systems or hardware, and against any other consequences of the accessing or downloading of inappropriate or illegal material.
It is the sole responsibility of each guest to ensure that any parental locks or other restrictions are in place, and we cannot accept any responsibility for any inappropriate access or use of the internet by children or others.

PARKING

Property parking is limited to the number Illustrated on the website. Vehicles are to be parked in designated parking areas only. Parking on the road or adjacent grassy verges is not permitted. Any illegally parked cars are subject to towing; applicable fines/towing fees are the sole responsibility of the vehicle owner.

SKIS, BICYCLES AND GOLF CLUBS

Guests bringing their own or rental ski equipment, bicycles or Golf Clubs to a Property must ensure that they are locked away. Please supply your own locks for bicycles and golf clubs and ensure that ski equipment is stored in the lockable ski store provided.

Heslop GmbH trading as Chalet Alp Lux will not be held responsible for the damage or theft to Ski equipment golf clubs or bicycles left on the property.  Skis Bicycles and golf clubs are not permitted inside the property.

SKI BOOTS

All Properties have heated storage for Ski boots, helmets can also be stored here.  Please note that ski boots are not to be worn in the Property.

TOBOGGANS

All properties have toboggans for your use. Please enjoy them and report any damages to Chalet Alp Lux or the Property Host.

WOOD BURNING STOVES

Selected properties have wood burning stoves. Please only use the wood supplied and never put anything on top of the stove! It gets very hot.

BBQ’S AND FIRE PIT

All properties have a BBQ and or a fire pit.  Please feel free to use, making sure that it is never left unattended.

FIRE EXTINGUISHER

There is a fire extinguisher in the property, if for any reason you cannot locate this upon arrival, please contact either Chalet Alp Lux or the Property Host.

DEBRIS/RUBBISH

It is important to recycle at your property.  There are clear instructions on the bins located at each of the properties.  Please adhere to the rules on waste disposal, it causes an enormous amount of hassle for the Property Housekeeping, any additional time taken will be deducted from the security deposit.

CLEANING

Dirty dishes are to be packed into the dishwasher and switched on prior to departure.  Pots and pans are to be washed.  The final clean cost has been built into your booking and covers the dusting, linen, windows, kitchen, bathrooms and cleaning of all the floors.

HOT TUBS AND SAUNAS

Some of the properties have a hot tub, sauna or both, information regarding these is illustrated on the Chalet Alp Lux website. Misuse and subsequent damage to a hot tub or a sauna can be expensive to repair. Heslop GmbH trading as Chalet Alp Lux ask that guests take note to the instructions listed in the Property Arrival document. The property Host will also take you through the do’s and dont’s and request your signature on the supplied disclaimer. Please report any issues or damages as soon as they are noticed so that they can be attended to immediately. Neglecting to follow instructions given can result in damage and the cost will be deducted from your security deposit.
